銷售條款和條件


第1條（目的）

本條款旨在規範V-GEN HK LIMITED（以下稱「本公司」）透過旗下電子商務平台（以下稱「本平台」）提供酒類相關商品銷售服務時，與客戶之間之權利義務關係。

第2條（定義）

  1. 「本平台」指本公司營運之線上酒類銷售網站及相關應用程式。
  2. 「客戶」指透過本平台購買商品之消費者。
  3. 「酒類商品」指根據香港法例第109章《應課稅品條例》定義之酒類產品。

第3條（購買資格）

  1. 客戶確認於下單時已年滿18歲，並同意於商品送達時或需出示有效身份證明文件（如香港身份證或護照）以供年齡驗證。
  2. 本公司保留要求客戶提供年齡證明之權利，若未能提供有效證明，本公司有權取消訂單。

第4條（訂購與付款）

  1. 所有商品價格均以港幣顯示，並已包含香港法律規定之相關稅項。
  2. 訂單經本公司確認後，客戶應按選擇之付款方式完成交易。

第5條（配送與驗收）

  1. 配送範圍限於香港特別行政區境內，部分偏遠地區可能需額外收取運費。
  2. 收貨時必須由年滿18歲之成年人簽收。

第6條（退換貨政策）

  1. 根據香港《貨品售賣條例》，酒類商品除因品質瑕疵或配送失誤外，一般不設退換。
  2. 如發現商品有破損或變質情況，請於收貨後24小時內聯絡客服處理。

第7條（責任限制）

  1. 客戶應理性飲酒，本公司對不當飲酒所引致之任何後果不承擔責任。
  2. 因不可抗力因素（如惡劣天氣、交通管制等）導致配送延誤，本公司不承擔相關責任。

第8條（個人資料保護）

本公司依據香港《個人資料（私隱）條例》處理客戶資料，詳細政策請參閱本公司之「私隱政策」。

第9條（知識產權）

本平台所有內容，包括但不限於商標、酒標設計等，均受香港知識產權法例保護。

第10條（條款修訂）

本公司有權隨時修訂本條款，修訂內容將於本平台公布，繼續使用服務即表示接受修訂。

第11條（爭議解決）

本條款受香港法律管轄，任何爭議應提交香港法院處理。

第12條（符合法規）

本公司嚴格遵守香港相關法規，包括但不限於：

  • 《應課稅品條例》
  • 《商品說明條例》
  • 《個人資料（私隱）條例》

**Terms and Conditions**


**Article 1 (Purpose)**

These Terms and Conditions aim to regulate the rights and obligations between V-GEN HK LIMITED (hereinafter referred to as "the Company") and customers regarding the sale of alcoholic products and related services provided through the Company's e-commerce platform (hereinafter referred to as "the Platform").


**Article 2 (Definitions)**

1.  "The Platform" refers to the online alcoholic beverage sales website and related applications operated by the Company.

2.  "Customer" refers to any consumer who purchases products through the Platform.

3.  "Alcoholic Products" refers to alcoholic products as defined under Hong Kong Law Chapter 109, the Dutiable Commodities Ordinance.


**Article 3 (Purchase Eligibility)**

1.  The customer confirms that they are at least 18 years old at the time of placing an order and agrees that they may be required to present valid identification (such as a Hong Kong Identity Card or Passport) for age verification upon delivery of the goods.

2.  The Company reserves the right to request age verification from the customer. If valid proof cannot be provided, the Company has the right to cancel the order.


**Article 4 (Ordering and Payment)**

1.  All product prices are displayed in Hong Kong Dollars and include relevant taxes as required by Hong Kong law.

2.  After an order is confirmed by the Company, the customer shall complete the transaction using the selected payment method.


**Article 5 (Delivery and Acceptance)**

1.  The delivery area is limited to within the Hong Kong Special Administrative Region. Additional delivery fees may apply to some remote areas.

2.  Upon delivery, the goods must be received and signed for by an adult aged 18 or above.


**Article 6 (Return and Exchange Policy)**

1.  In accordance with the Hong Kong Sale of Goods Ordinance, alcoholic products generally cannot be returned or exchanged, except in cases of quality defects or delivery errors.

2.  If products are found to be damaged or spoiled, please contact customer service within 24 hours of receipt for resolution.


**Article 7 (Limitation of Liability)**

1.  Customers are advised to drink responsibly. The Company shall not be liable for any consequences resulting from the irresponsible consumption of alcohol.

2.  The Company shall not be liable for delivery delays caused by force majeure events (such as severe weather, traffic restrictions, etc.).


**Article 8 (Personal Data Protection)**

The Company handles customer data in accordance with the Hong Kong Personal Data (Privacy) Ordinance. For detailed policies, please refer to the Company's "Privacy Policy".


**Article 9 (Intellectual Property)**

All content on this Platform, including but not limited to trademarks and label designs, is protected under Hong Kong intellectual property laws.


**Article 10 (Revision of Terms)**

The Company reserves the right to revise these Terms at any time. Revised content will be announced on the Platform. Continued use of the services signifies acceptance of the revisions.


**Article 11 (Dispute Resolution)**

These Terms are governed by the laws of Hong Kong. Any disputes shall be submitted to the Hong Kong courts for resolution.


**Article 12 (Compliance with Regulations)**

The Company strictly complies with relevant Hong Kong regulations, including but not limited to:

*   Dutiable Commodities Ordinance

*   Trade Descriptions Ordinance

*   Personal Data (Privacy) Ordinance
